An act to make public records and information more freely available, provide for public access to public records and information, protect public records and information to the extent consistent with the public interest and the protection of personal privacy, protect serving public officers from adverse consequences for disclosing certain kinds of official information without authorization and establish procedures for the achievement of those purposes and related purposes thereof.

• These regulations provide for the undertaking of ‘appropriate’ technical & organisational measures to safeguard security of services provided.

The subsidiary legislation indicated below falls under the Data Protection Act:

• S.L. 440.01 – Processing of Personal Data (Electronic Communications Sector) Regulations which includes provisions relating to ‘location of data’ and ‘traffic data’ covering data processing, the persons authorised to do so and data retention provisions;

• S.L. 440.05 – Data Protection (Processing of Personal Data in the Police Sector) Regulations

The above provisions prohibit the unlawful access to, or unlawful use of information available on computers including misuse of the same (including hardware).
